(وَلَوْ مَاتَ) الْوَالِي (قَبْلَ إمْكَانِ رَفْعِهِ إلَيْهِ حَنِثَ) لِفَوَاتِ الرَّفْعِ، كَمَا لَوْ حَلَفَ لَيَضْرِبَنَّ عَبْدَهُ غَدًا فَمَاتَ الْيَوْمَ
