شرح منتهى الإراداتal-Buhuti

(وَيَأْمُرُهُ) أَيْ: الْإِمَامُ إذَا وَلَّاهُ (بِالتَّقْوَى) لِأَنَّهَا رَأْسُ الْأَمْرِ وَمِلَاكُهُ. (وَ) يَأْمُرُهُ (بِتَحَرِّي الْعَدْلِ) أَيْ: إعْطَاءِ الْحَقِّ لِمُسْتَحِقِّهِ بِلَا مَيْلٍ لِأَنَّهُ الْمَقْصُودُ مِنْ الْقَضَاءِ

معونة أولي النهىIbn al-Najjar

(ويأمره) عند ولايته (بالتقوى) ؛ لأن التقوى رأس الدين. (و) يأمره أيضًا بـ (تحرّي العدل) ، والعدل: إعطاء الحق لمستحقه من غير ميل. وهذا هو المقصرد من القضاء.
