(والبينة) في الاصطلاح: (العلامةُ الواضحةُ؛ كالشاهد فأكثر) .

والأصل في هذا الباب ما روى ابن عباس أن النبي صلى الله عليه وسلم قاله:" لو يُعطى الناس (٣) بدعواهم لادَّعى ناسى دماءَ رجالٍ وأموالَهم. ولكن اليمين على المدعى عليه " . رواه أحمد ومسلم.
