(وَلَا يَضْمَنُ نَاقِدٌ حَاذِقٌ أَمِينٌ خَطَأً) مُتَبَرِّعًا كَانَ أَوْ بِأُجْرَةٍ ; لِأَنَّهُ أَمِينٌ فَإِنْ لَمْ يَكُنْ حَاذِقًا أَوْ أَمِينًا ضَمِنَ كَمَا لَوْ تَعَمَّدَ.
