(لَكِنْ يُعْتَبَرُ فِي) جَوَازِ (قَبْضِ مُشَاعٍ) كَثُلُثٍ وَنِصْفٍ مِمَّا (يُنْقَلُ) كَغَرْسٍ لَا عَقَارٍ (إذْنُ شَرِيكِهِ) أَيْ الْبَائِعِ، إذْ لَا يُمْكِنُ قَبْضُ الْبَعْضِ إلَّا بِقَبْضِ الْكُلِّ
