(لَا) يَصِحُّ أَخْذُ رَهْنٍ (بِدِيَةٍ عَلَى عَاقِلَةٍ وَ) لَا (بِجُعَلٍ قَبْلَ) مُضِيِّ (حَوْلٍ) فِي مَسْأَلَةِ الدِّيَةِ (وَ) قَبْلَ تَمَامِ (عَمَلٍ) فِي مَسْأَلَةِ الْجُعَلِ ; لِأَنَّهُ غَيْرُ وَاجِبٍ وَلَا يُعْلَمُ أَنَّهُ يَئُولُ إلَيْهِ
