(وَإِنْ شُرِطَ خِيَارٌ فِي ضَمَانٍ أَوْ) فِي (كَفَالَةٍ) بِأَنْ قَالَ: أَنَا ضَمِينٌ بِمَا عَلَيْهِ أَوْ كَفِيلٌ بِبَدَنِهِ وَلِيَ الْخِيَارُ ثَلَاثَةَ أَيَّامٍ مَثَلًا (فَسَدَ) أَيْ الضَّمَانُ وَالْكَفَالَةُ لِمُنَافَاتِهِ لَهُمْ
