(وَكَذَا الشِّرَاءُ) فَالْوَكِيلُ فِيهِ يَمْلِكُ تَسْلِيمَ الثَّمَنِ وَلَا يَمْلِكُ تَسْلِيمَ الْمَبِيعِ إلَّا بِإِذْنٍ صَرِيحٍ عَلَى مَا تَقَدَّمَ

معونة أولي النهىIbn al-Najjar

(وكذا) أي: وكالمبيع في كون الوكيل فيه لا يملك قبض العوض إلا بإذن صريح يكون (الشراء) . فلا يملك الوكيل في الشراء تسليم المبيع إلا بإذن صريح.
