شرح منتهى الإراداتal-Buhuti

(فَإِنْ أَبَيَاهُ) أَيْ: أَبَى مُعِيرٌ وَمُسْتَعِيرٌ الْبَيْعَ (تُرِكَ) غِرَاسٌ أَوْ بِنَاءٌ (بِحَالِهِ) فِي الْأَرْضِ حَتَّى يَتَّفِقَا ; لِأَنَّ الْحَقَّ لَهُمَا.

معونة أولي النهىIbn al-Najjar

(وإن أبياه) اي: أبى المعير والمستعير البيع (تُرك) الغراس أو البناء (بحاله) في الأرض حتى يتفقا؛ لأن الحق لهما.

وقيل: يبيعهما الحاكم.
