(وَ) إنْ قَالَ الْمَرِيضُ لِابْنِ عَمِّهِ وَنَحْوَهُ (أَنْتَ حُرٌّ آخِرَ حَيَاتِي) ثُمَّ مَاتَ الْمَرِيضُ (عَتَقَ) ابْنُ عَمِّهِ وَنَحْوُهُ لِوُجُودِ شَرْطِ عِتْقِهِ (وَوَرِثَ) لِسَبْقِ الْحُرِّيَّةِ الْإِرْثَ
