(وَلِلْوَرَثَةِ قِيمَتُهُ عِنْدَ وَضْعٍ عَلَى وَاطِئٍ) لِأَنَّهُ فَوَّتَ رِقَّهُ عَلَيْهِمْ بِاعْتِقَادِهِ حُرِّيَّتَهُ. وَاعْتُبِرَتْ حَالُ الْوَضْعِ لِأَنَّهُ أَوَّلُ أَوْقَاتِ إمْكَانَ تَقْوِيمِهِ

معونة أولي النهىIbn al-Najjar

(وللورثة قيمته عند وضع على واطئ) ؛ لأنه لما امتنع رقه وجب لمن كان له لو لم يمتنع رقه جبر ما فات من رقه. وإنما اعتبرت القيمة عند الوضع؛ لأنها لا تعلم قبل ذلك. فوجب اعتبارها بأو ل حالة تعلم بها.
