(وَ) إنْ قَالَ لِأَمَتِهِ (آخِرُ وَلَدٍ تَلِدِينَهُ حُرٌّ فَوَلَدَتْ حَيًّا ثُمَّ مَيِّتًا لَمْ يُعْتَقْ الْأَوَّلُ) ; لِأَنَّهُ لَمْ تُوجَدْ الصِّفَةُ فِيهِ
