(لَا) تَصِحُّ الْكِتَابَةُ (مِنْهُ) أَيْ: الْمُمَيِّزِ بِأَنْ يُكَاتِبَ مُمَيِّزٌ رَقِيقَهُ (إلَّا بِإِذْنِ وَلِيِّهِ) ; لِأَنَّهَا تَصَرُّفٌ فِي الْمَالِ فَلَمْ يَصِحَّ مِنْ الْمُمَيِّزِ إلَّا بِإِذْنِ وَلِيِّهِ كَالْبَيْعِ

(لا منه) يعني: انه لا يصح من السيد المميز كتابة رقيقه (إلا بإذن وليه) ؛ لأن الكتابة تصرف في المال. فلم تصح من المميز إلا بإذن وليه؛ كالبيع.
