(وَلَا يُحْتَسَبُ عَلَيْهِ) أَيْ الْمُكَاتَبِ (بِمُدَّةِ الْأَسْرِ) الَّتِي هُوَ فِيهَا عِنْدَ الْكُفَّارِ لِأَنَّهَا لَيْسَتْ بِتَفْرِيطِهِ وَلَا فِعْلِهِ
