(وَيُجْزِئُ تَسَرٍّ عَنْهُ) أَيْ النِّكَاحِ حَيْثُ وَجَبَ أَوْ اُسْتُحِبَّ لِقَوْلِهِ تَعَالَى: {فَوَاحِدَةً أَوْ مَا مَلَكَتْ أَيْمَانُكُمْ} وَالتَّخْيِيرُ إنَّمَا يَكُونُ بَيْنَ مُتَسَاوِيَيْنِ

(و) حيث وجب النكاح أو استحب فإنه (يجزئى تسر عنه) ، لأن الله سبحانه وتعالى خير بين النكاح وملك اليمين بقوله: (فواحدة أوماملكت أيمانكم) . والتخيير إنما يكون بين متساويين.
