شرح منتهى الإراداتal-Buhuti

(وَهُوَ) أَيْ خِيَارُ الْفَسْخِ لِفَقْدِ الْكَفَاءَةِ (عَلَى التَّرَاخِي) ; لِأَنَّهُ لِنَقْصٍ فِي الْمَعْقُودِ عَلَيْهِ أَشْبَهَ خِيَارَ الْعَيْبِ
