شرح منتهى الإراداتal-Buhuti

(لَا) يَحْصُلُ اخْتِيَارٌ (بِظِهَارٍ أَوْ إيلَاءٍ) ; لِأَنَّهُمَا كَمَا يَدُلَّانِ عَلَى التَّصَرُّفِ فِي الْمَنْكُوحَةِ يَدُلَّانِ عَلَى اخْتِيَارِ تَرْكِهَا فَيَتَعَارَضُ الِاخْتِيَارُ وَعَدَمُهُ فَلَا يَثْبُتُ وَاحِدٌ مِنْهُمَا.

معونة أولي النهىIbn al-Najjar

(لا بظهار أو إيلاء) في الأصح، لأن الظهار والإيلاء كما يدلان على التصرف في المنكوحة يدلان على اختيار تركها. فيتعارض الاختيار وعدمه. فلا يثبت واحد منهما.
