وَإِنْ بَانَ مَعِيبًا فَلَهُ أَرْشُهُ أَوْ قِيمَتُهُ، وَيَرُدُّهُ

(وَإِنْ بَانَ) نَحْوُ الْعَبْدِ الْمُخَالَعِ عَلَيْهِ (مَعِيبًا فَلَهُ أَرْشُهُ أَوْ قِيمَتُهُ، وَيَرُدُّهُ) كَالْمَبِيعِ فَيُخَيَّرُ بَيْنَهُمَا.

(وإن بان) ما خالعها عليه (معيباً: فله أرشه، أو قيمته ويرده)
. يعني:
فيخير الزوج بين أخذ أرشه وبين رده وأخذ قيمته؛ لأنه عوض في معاوضة. فيستحق فيه ذلك؛ كالبيع.
