شرح منتهى الإراداتal-Buhuti

(حَيًّا أَوْ مَيِّتًا) ; لِأَنَّ الشَّرْطَ وِلَادَتُهُ، وَقَدْ وُجِدَتْ. وَلِأَنَّ الْعِدَّةَ تَنْقَضِي بِهِ وَتَصِيرُ الْأَمَةُ بِهِ أُمَّ وَلَدٍ.

معونة أولي النهىIbn al-Najjar

(ولا فرق بين) كون (من تلده حيَّاً أو ميتاً) ؛ لأن الشرط ولادة ذكر أو أنثى وقد وجدت.

ولأن العدة تنقضى به وتصير به الأمة أمَّ ولد فيكون معتبراً. كذلك هنا.
