شرح منتهى الإراداتal-Buhuti

(لَا) يَحْصُلُ بِقَوْلِ مُطَلِّقٍ (نَكَحْتُهَا أَوْ تَزَوَّجْتُهَا) لِأَنَّهُ كِنَايَةٌ وَالرَّجْعَةُ اسْتِبَاحَةُ بُضْعٍ مَقْصُودٍ فَلَا تَحْصُلُ بِكِنَايَةٍ كَالنِّكَاحِ.
