النهر الفائق'Umar Ibn Nujaym

(وإن قتل) / نفساً معصومة ولم يقيده به لأنه إذا علم التقييد به في المال ففي النفس أولى ولم يأخذ مالاً (قتل حداً) حقاً لله تعالى وفي (السراج) أي: سياسة لا قصاصاً (وإن عفا الولي) تصريح بما علم من قوله حداً

وأشار به إلى أنه لا يشترط أن يكون موجباً للقصاص من مباشرة القتل والآلة لأنه وجب جزاء الجناية لمحاربته لله تعالى وهي موجودة بالقتل ولو أعانه بذلك قضى عليه الصلاة والسلام في أصحاب أبي بردة.
