النهر الفائق'Umar Ibn Nujaym

(بخلاف المبيع) إذا أمر المشتري البائع أم يكيله في ظرفه وهو غائب حيث يكون قابضاً لأن ملكه بالشراء فصح أمره، وأورد أنه لو وكل البائع بالقبض صريحاً لم يصح فعدم الصحة هنا أولى.

وأجيب بأنه لما صح أمره لكونه مالكاً صار وكيلاً له ضرورة وكم من شيء يثبت ضماناً لا قصداً،
