(وَدَعْوَى الْوَلِيِّ عَلَى وَاحِدٍ مِنْ غَيْرِ أَهْلِ الْمَحَلَّةِ تُسْقِطُ الْقَسَامَةَ عَنْهُمْ وَعَلَى مُعَيَّنٍ مِنْهُمْ لَا) وَقَدْ ذَكَرْنَاهُ مَعَ تَشَعُّبِهِ وَالِاخْتِلَافِ فِيهِ وَالْقِيَاسِ وَالِاسْتِحْسَانِ فِيهِ فَلَا نُعِيدُهُ.
