(فَإِنْ لَمْ يُوصِ الْأَبُ فَالْجَدُّ كَالْأَبِ) لِأَنَّهُ أَقْرَبُ النَّاسِ إلَيْهِ وَأَشْفَقُهُمْ عَلَيْهِ حَتَّى مَلَكَ الْإِنْكَاحَ دُونَ الْوَصِيِّ غَيْرَ أَنَّهُ إنْ أَوْصَى الْأَبُ يُقَدَّمُ عَلَيْهِ الْوَصِيُّ فِي التَّصَرُّفِ فِي الْمَالِ لِمَا بَيَّنَّا دُونَ غَيْرِهِ،
