(والحرية) فلا تجب على عبد مطلقًا، وصحح في (السراج) وجوبها على المكاتب ومعتق البعض،

وبالثاني: جزم في (الظهيرية) وهو الأليق بالقواعد والإطلاق ولو حضر مع مولاه المسجد لحفظ ماله فالأصح أن له أن يصليها حيث لم يخل بحفظ مال المولى،

ولو ذهب إليها بغير إذنه إن علم رضاه جاز وإلا لا، كذا في (التجنيس) .
