(وَأَرْكَانُهُ ثَلَاثَةٌ: مُوَرِّثٌ وَوَارِثٌ وَحَقٌّ مَوْرُوثٌ) .

وَشُرُوطُهُ ثَلَاثَةٌ: تَحَقُّقُ حَيَاةِ الْوَارِثِ أَوْ إلْحَاقُهُ بِالْأَحْيَاءِ، وَتَحَقُّقُ مَوْتِ الْمُوَرِّثِ أَوْ إلْحَاقُهُ بِالْأَمْوَاتِ، وَالْعِلْمُ بِالْجِهَةِ الْمُقْتَضِيَةِ لِلْإِرْثِ، وَتُعْلَمُ مِمَّا يَأْتِي.
