(وَلَوْ أَوْلَدَ) مَجُوسِيٌّ أَوْ نَحْوُهُ (بِنْتَه بِنْتًا بِتَزْوِيجٍ، فَخَلَّفَهُمَا وَ) خَلَّفَ مَعَهُمَا (عَمًّا فَلَهُمَا الثُّلُثَانِ) ؛ لِأَنَّهُمَا بِنْتَاهُ (وَالْبَقِيَّةُ لِعَمِّهِ) تَعْصِيبًا، وَلَا إرْثَ لِلْكُبْرَى بِالزَّوْجِيَّةِ؛؛ لِأَنَّهُمَا لَا يُقَرَّانِ عَلَيْهَا لَوْ أَسْلَمَا أَوْ أَحَدُهُمَا
