مطالب أولي النهىal-Ruhaybani

(فَإِنْ مَاتَ الْأَبُ وَرِثَاهُ) ؛ أَيْ: ابْنُهُ وَبِنْتُهُ (أَثْلَاثًا بِالنَّسَبِ) لِأَنَّ عَصَبَةَ النَّسَبِ مُقَدَّمَةٌ عَلَى عَصَبَةِ الْوَلَاءِ، وَمِيرَاثُ النَّسَبِ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ (وَإِنْ مَاتَتْ الْبِنْتُ بَعْدَهُ) ؛ أَيْ: بَعْدَ الْأَبِ (وَرِثَهَا أَخُوهَا بِهِ) ؛ أَيْ: بِالنَّسَبِ؛ لِأَنَّهُ مُقَدَّمٌ عَلَى الْوَلَاءِ
