(وَلَا عِتْقَ بِخَدْشٍ وَضَرْبٍ وَلَعْنٍ) لِأَنَّهُ لَا نَصَّ فِي الْعِتْقِ بِذَلِكَ، وَلَا هُوَ فِي مَعْنَى الْمَنْصُوصِ عَلَيْهِ، فَلَمْ يَعْتِقْ بِذَلِكَ كَمَا لَوْ هَدَّدَهُ
