(وَ) مَنْ قَالَ لِقِنِّهِ: أَنْتَ حُرٌّ (عَلَى أَنْ تَخْدُمَنِي سَنَةً) وَنَحْوَهَا كَشَهْرٍ فَإِنَّهُ (يَعْتِقُ) فِي الْحَالِ (بِلَا قَبُولٍ) مِنْهُ (وَتَلْزَمُهُ الْخِدْمَةُ) لِأَنَّهُ فِي مَعْنَى الْعِتْقِ وَاسْتِثْنَاءِ الْخِدْمَةِ، وَهُوَ صَحِيحٌ
