(وَ) قَالَ مَالِكٌ رَقِيقَيْنِ (أَعْتَقْتَ هَذَا، لَا بَلْ هَذَا عَتَقَا) جَمِيعًا؛ لِأَنَّ إضْرَابَهُ عَنْ الْأَوَّلِ لَا يُبْطِلُهُ (وَكَذَا) الْحُكْمُ فِي (إقْرَارِ وَارِثٍ) إذَا قَالَ: مُوَرِّثِي أَعْتَقَ هَذَا، لَا بَلْ هَذَا؛ عَتَقَ الِاثْنَانِ؛ لِمَا يَأْتِي فِي الطَّلَاقِ.
