(وَ) لِلْمُكَاتَبِ (تَمَلُّكُ رَحِمِهِ الْمُحَرَّمِ) كَأَبِيهِ وَأَخِيهِ وَعَمِّهِ وَخَالِهِ (بِهِبَةٍ وَوَصِيَّةٍ، وَ) لَهُ (شِرَاؤُهُمْ وَفِدَاؤُهُمْ) إذَا جُنُّوا، وَهُمْ فِي يَدِهِ (وَلَوْ أَضَرَّ ذَلِكَ فِي مَالِهِ) ؛ أَيْ: الْمُكَاتَبِ؛ لِأَنَّ فِيهِ تَحْصِيلًا لِحُرِّيَّتِهِمْ بِتَقْدِيرِ عِتْقِهِ، وَالْعِتْقُ مَطْلُوبٌ شَرْعًا
