(وَإِنْ عَتَقَ الْعَبْدُ وَتَحْتَهُ أَمَةٌ؛ فَلَا خِيَارَ لَهُ، بِخِلَافِ عَكْسِهِ) بِأَنْ عَتَقَتْ الْأَمَةُ تَحْتَ عَبْدٍ؛ فَلَهَا الْخِيَارُ (لِأَنَّ الْكَفَاءَةَ تُعْتَبَرُ فِيهِ) أَيْ: الرَّجُلِ (لَا فِيهَا) أَيْ: الْمَرْأَةِ.
