(وَإِنْ اخْتَارَهُ) أَيْ: اخْتَارَ الزَّوْجُ أَخْذَ نِصْفِ الْمَهْرِ (نَاقِصًا بِجِنَايَةٍ) عَلَيْهِ كَأَنْ فُقِئَتْ عَيْنُهُ وَنَحْوُهُ بِجِنَايَةٍ (فَلَهُ) أَيْ: الزَّوْجِ (مَعَ) أَيْ: أَخْذِ نِصْفِهِ نَاقِصًا بِالْجِنَايَةِ (نِصْفُ أَرْشِهَا) أَيْ: الْجِنَايَةِ؛ لِأَنَّهُ فِي نَظِيرِ مَا ذَهَبَ مِنْهُ.
