(وَ) زَوْجٌ (مُمَيِّزٌ) يَعْقِلُ الطَّلَاقَ (وَ) زَوْجَةٌ (مُمَيِّزَةٌ) تَعْقِلُ (كَ) زَوْجَيْنِ (بَالِغَيْنِ فِيمَا تَقَدَّمَ) تَفْصِيلُهُ نَصًّا؛ لِأَنَّ مَنْ صَحَّ مِنْهُ شَيْءٌ صَحَّ أَنْ يُوَكِّلَ فِيهِ، وَأَنْ يَتَوَكَّلَ. [
