(وَإِنْ قَالَ) زَوْجٌ (لِأَجْنَبِيَّةٍ ظَنَّهَا زَوْجَتَهُ فُلَانَةَ) وَسَمَّى زَوْجَتَهُ: (أَنْتِ طَالِقٌ، أَوْ لَمْ يُسَمِّهَا) أَيْ: زَوْجَتَهُ، بَلْ قَالَ لِمَنْ ظَنَّهَا زَوْجَتَهُ: أَنْتِ طَالِقٌ مِنْ غَيْرِ أَنْ يَقُولَ فُلَانَةَ (طَلُقَتْ زَوْجَتُهُ) اعْتِبَارًا بِالْقَصْدِ، دُونَ الْخِطَابِ
