مطالب أولي النهىal-Ruhaybani

(وَلَا يَلْزَمُهُ) أَيْ: السَّيِّدَ (بَيْعُهُ بِطَلَبِهِ) أَيْ: الرَّقِيقِ (مَعَ الْقِيَامِ بِحَقِّهِ) ؛ لِأَنَّ الْمِلْكَ لِلسَّيِّدِ، وَالْحَقُّ لَهُ، كَمَا لَا يُجْبَرُ عَلَى طَلَاقِ زَوْجَتِهِ مَعَ قِيَامِهِ بِمَا يَجِبُ لَهَا فَإِنْ لَمْ يَقُمْ بِحَقِّهِ؛ وَطَلَبَ بَيْعَهُ، لَزِمَهُ إجَابَتُهُ.
