(وَيَتَعَيَّنُ دِيَةُ قَوَدٍ لَزِمَ بَعْدَ مُحَارَبَتِهِ) بِأَنْ قَتَلَ بَعْدَهُمَا عَمْدًا مُكَافِئًا (لِتَقْدِيمِهَا) ؛ أَيْ: الْمُحَارَبَةِ (بِسَبَقِهَا، وَكَذَا لَوْ مَاتَ) مُحَارِبٌ لَزِمَهُ قَوَدٌ بَعْدَ مُحَارَبَتِهِ
