(وَلَا) تَنْعَقِدُ الْيَمِينُ (مِنْ نَحْوِ نَائِمٍ) كَمُغْمَى عَلَيْهِ (وَمَجْنُونٍ وَصَغِيرٍ) وَمَعْتُوهٍ؛ لِأَنَّهُمْ لَا قَصْدَ لَهُمْ (وَعَلَيْهِ فَلَا يَصِحُّ إيلَاؤُهُ) أَيْ: الصَّغِيرِ؛ لِأَنَّهُ مَرْفُوعٌ عَنْهُ الْقَلَمُ. الشَّرْطُ
