مطالب أولي النهىal-Ruhaybani

(لَا إنْ حَلَفَ عَلَى شَيْءٍ لَا يَنْتَفِعُ بِهِ قَطْعًا لِلْمِنَّةِ، فَانْتَفَعَ بِهِ هُوَ) ، أَيْ: الْحَالِفُ، (أَوْ) انْتَفَعَ بِهِ (أَحَدٌ مِمَّنْ هُوَ فِي كَنَفِهِ) ، أَيْ: حِيَازَتِهِ وَتَحْتَ نَفَقَتِهِ مِنْ زَوْجَةٍ أَوْ رَقِيقٍ أَوْ وَلَدٍ صَغِيرٍ (حَنِثَ) ؛ لِأَنَّهُمْ فِي حُكْمِهِ.
