(وَ) مَنْ حَلَفَ (لَا يَطَأُ امْرَأَتَهُ أَوْ أَمَتَهُ، حَنِثَ بِجِمَاعِهَا) ، أَيْ: الْمَحْلُوفِ عَلَيْهَا، لِانْصِرَافِ اللَّفْظِ إلَيْهِ عُرْفًا، وَلِذَلِكَ لَوْ حَلَفَ عَلَى تَرْكِ وَطْءِ زَوْجَتِهِ كَانَ مُولِيًا،
