(لَا) يَمْلِكُ مَالًا (بِمُسْتَأْجَرٍ وَلَا بِوَاجِبِ حَقِّ شُفْعَةٍ) قَبْلَ أَخْذِهَا؛ لِأَنَّهُ لَا يُسَمَّى (مَالًا) عُرْفًا.
