(لَا) يَحْنَثُ (إنْ جُنَّ حَالِفٌ) لَيَفْعَلَنَّ كَذَا غَدًا أَوْ فِي غَدٍ (قَبْلَ الْغَدِ حَتَّى خَرَجَ الْغَدُ) ، أَيْ: الْمَجْنُونُ لَيْسَ مِنْ أَهْلِ الْحِنْثِ؛ لِأَنَّهُ لَا يُنْسَبُ إلَيْهِ فِعْلٌ وَلَا تَرْكٌ يُعْتَدُّ بِهِ،
