(وَإِنْ كَانَ الْحَقُّ عَيْنًا) كَعَارِيَّةٍ أَوْ وَدِيعَةٍ (فَوُهِبَتْ لَهُ) ، أَيْ: الْغَرِيمِ الْحَالِفِ (وَقَبِلَ الْهِبَةَ - حَنِثَ) بِفِرَاقِهِ؛ لِتَرْكِهِ الْوَفَاءَ بِاخْتِيَارِهِ، وَلَا يَحْنَثُ
