(وَتَخْتَصُّ الْيَمِينُ بِمُدَّعًى عَلَيْهِ دُونَ مُدَّعٍ) بِلَا نِزَاعٍ (إلَّا فِي الْقَسَامَةِ) إذَا تَوَفَّرَتْ شُرُوطُهُمَا (وَإِلَّا مَعَ الشَّاهِدِ) عَلَى مُدَّعٍ، وَتَقَدَّمَ.
