(وَقَالَ أَحَدُهُمَا: قَضَاهُ بَعْضَهُ؛ بَطَلَتْ شَهَادَتُهُ نَصًّا) لِأَنَّ قَوْلَهُ قَضَاهُ بَعْضَهُ يُنَاقِضُ شَهَادَتَهُ عَلَيْهِ بِالْأَلْفِ، فَأَفْسَدَهَا، وَلَهُ أَنْ يَحْلِفَ مَعَ الْآخَرِ، وَيَسْتَحِقَّ الْأَلْفَ عَلَى قِيَاسِ مَا تَقَدَّمَ.
