(إنْ قَالَ) لَهُ الدَّارُ إلَّا (ثُلُثَيْهَا وَنَحْوَهُ) كَالثَّلَاثَةِ أَرْبَاعِهَا أَوْ خَمْسَةِ أَسْدَاسِهَا؛ لِأَنَّ الْمُقَرَّ بِهِ شَائِعٌ، وَهُوَ أَكْثَرُ مِنْ النِّصْفِ.
