(وَإِذَا قَالَ الصَّحَابِيُّ مَا يُخَالِفُ الْقِيَاسَ، فَهُوَ تَوْقِيفٌ) مِنْهُ عَلَى النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَيَجِبُ الْعَمَلُ بِهِ؛ لِأَنَّهُ لَا يُمْكِنُ أَنْ يَكُونَ عَنْ اجْتِهَادٍ، فَهُوَ فِي حُكْمِ الْمَرْفُوعِ.
