لَا أَنْف مِنْ ذَهَبٍ وَيُحَطُّ ثَمَنُهُ، إنْ لَمْ يُؤْخَذْ مِنْ تَرِكَتِهِ فَإِنْ عُدِمَتْ أُخِذَ إذَا بُلِيَ مَيت.

مطالب أولي النهىal-Ruhaybani

(لَا) يُزَالُ (أَنْفٌ مِنْ ذَهَبٍ) .

لِمَا فِيهِ مِنْ الْمُثْلَةِ، (وَيُحَطُّ ثَمَنُهُ، إنْ لَمْ يُؤْخَذْ) ، أَيْ: إنْ لَمْ يَكُنْ بَائِعُهُ أَخَذَهُ مِنْ الْمَيِّتِ (مِنْ تَرِكَتِهِ) كَسَائِرِ دُيُونِهِ، (فَإِنْ عُدِمَتْ) تَرِكَةُ الْمَيِّتِ (أُخِذَ) الْأَنْفُ (إذَا بُلِيَ مَيِّتٌ) ، لِعَدَمِ الْمَانِعِ إذَنْ.
