(وَإِذَا صَارَ الْمَيِّتُ تُرَابًا؛ جَازَ حَرْثُ قَبْرِهِ لِزَرْعٍ وَغَيْرِهِ) كَبِنَاءٍ، قَالَهُ أَبُو الْمَعَالِي. (وَالْمُرَادُ) بِقَوْلِ أَبِي الْمَعَالِي: إذَا كَانَ الْقَبْرُ (بِغَيْرِ مُسَبَّلَةٍ) أَمَّا فِيهَا؛ فَلَا.
